Data collection on our website
Data collection without cookies
Use of the open source web analysis software Matomo (formerly Piwik)
On our websites, data is collected and stored using the open source software Matomo (www.matomo.org, formerly Piwik), based on our legitimate interest in the statistical analysis of user behavior for range measurement and optimization purposes pursuant to Art. 6 paragraph 1, letter f of GDPR. Anonymous usage profiles can be created and evaluated from this data for the same purpose.
If you access individual pages of our websites, we store the following data with Matomo:
- 3 bytes of the IP address of your calling system
- the address of the accessed website
- the address of the website from which you, the user, reached the accessed website (referrer)
- the address of the subpages that are accessed from the access website
- the time spent on the website
- the screen resolution of the device you used to access the website
- the length of time it took you to fully communicate with our server and how long it took our server to respond
We deliberately do not use cookies when using Matomo. The data collected using Matomo technology (including your anonymized IP address) is processed on our own servers in Germany and is never passed on or sold to third parties. Due to the anonymization, the information generated by Matomo cannot be used to personally identify you as a visitor to our website.
Matomo is a web analysis software by the provider InnoCraft Ltd, 150 Willis St, 6011 Wellington, New Zealand.
Revocation of data storage by Matomo (formerly Piwik)
If you do not agree with the storage and analysis of this data from your visit, then you can object to the storage and use at any time:
Click here to adjust your consent to the storage and use of the data
In that case, a so-called opt-out cookie will be placed in your browser, with the result that Matomo will not collect any session data. Please note that the complete deletion of your cookies will result in the opt-out cookie also being deleted and you may have to reactivate it.
Use of cookies for data collection
We also collect data on our websites using cookies and tracking pixels.
If you come to our website through an ad from Google Ads or Microsoft Advertising, we will show you a Consent Banner. With your full or partial consent in our Consent Banner, you agree that we may collect data with the use of cookies, among other methods. In doing so, we operate cross-domain tracking. This means that your settings apply to all our websites www.jam-software.com and www.jam-software.de including subdomains.
Click here to adjust your consent to the use of cookies
Cookies are small text files that are placed on your computer and stored by your browser. Cookies do not cause any damage to your computer and do not contain viruses. They rather serve to make our website more user-friendly, effective and secure.
You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.
Types of cookies used
We divide the cookies we use on our website into three categories: 1. Technically-Necessary Cookies, 2. Cookies for our Statistics and 3. Cookies for Marketing.
1. Technically-Necessary Cookies
Most of the cookies we use are so-called "session cookies", which are automatically deleted after the end of your visit. Other cookies remain stored on your terminal device until you delete them. These cookies enable us to recognize your browser on your next visit.
Cookies that are required to carry out the electronic communication process or to provide certain functions that you have requested (e.g. the shopping cart function) are stored on the basis of Art. 6 paragraph 1, letter f of GDPR. As a website operator, we have a legitimate interest in storing cookies for the technically error-free and optimized provision of our services.
2. Cookies for our Statistics
We reserve the right to use statistics cookies to aggregate anonymously collected interactions, for example to better track downloads of demo or full versions of our products.
We also deliberately and entirely refrain from using Google Analytics.
3. Cookies for Marketing
We use marketing cookies solely for search engine advertisements. These are only used if you have come to our website via an advertisement placed on Google or Bing. If you come to our websites via organic search with a search engine or via a direct link call (for example, via social media), these cookies are not set.
Google Ads
Our website uses cookies for Google Ads for so-called conversion tracking and the remarketing function. These are only used if you have previously clicked on an ad placed by us on Google. Google is thereby instructed by us to anonymize your IP addresses.
If the user visits certain pages of our websites, Google and we can recognize that the user clicked on an ad and was redirected to that page. This only works as long as the respective cookie has not yet expired. The information obtained using the conversion cookies is used to track ad performance. We do not receive any information with which users can be personally identified. The cookies set for Google Ads lose their validity after different periods of time. The respective cookie durations can be viewed in the cookie list in this privacy policy.
The remarketing function makes it possible to link the advertising target groups created with Google Ads Remarketing with the cross-device functions of Google Ads. In this way, interest-based, personal advertising messages that have been adapted to you depending on your previous usage and surfing behavior on one end device (e.g. your cell phone) can also be displayed on another of your end devices (e.g. your tablet or PC). If you have given your consent, Google will link your web and app browsing history with your Google account for this purpose. In this way, the same personal advertising messages can be displayed on each end device on which you log in with your Google account.
Google Ads is an online advertising program of Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ("Google"). Further information and the data protection provisions can be found in Google's data protection declaration at: https://www.google.com/policies/technologies/ads/.
In addition, you can permanently object to cross-device remarketing by deactivating personal advertising in your Google account - follow this link: https://www.google.com/settings/ads/onweb/.
The aggregation of the collected data in your Google account is based solely on your consent, which you can give or revoke at Google (Art. 6 paragraph 1, letter f of GDPR).
Bing Ads
Our websites use Bing UET tags (Bing Universal Event Tracking). These are only used if you have previously clicked on an ad placed by us on Bing. It is a code that, in conjunction with a cookie, stores some non-personal data about the use of the website.
Bing UET tags are a service of Microsoft Corporation (One Microsoft Way Redmond, WA 98052-6399, USA). For more information about Bing's analytics services, please visit the Bing Ads website: https://help.bingads.microsoft.com/#apex/3/de/53056/2.
For more information about Microsoft's and Bing's privacy practices, please see Microsoft's privacy policy.
Users of this website can disable Bing's use of cookies following this link: https://account.microsoft.com/privacy/ad-settings.

Server log files
The website provider automatically collects and stores information that your browser automatically transmits to us in "server log files". These are:
- Browser type and browser version
- Operating system used
- Referrer URL
- Host name of the accessing computer
- Time of the server request
- IP address
These data will not be combined with data from other sources. We would like to point out that you can deactivate the transmission of the aforementioned information in the privacy and security settings of your browser ("Do Not Track").
The basis for data processing is Art. 6 (1) (b) DSGVO, which allows the processing of data to fulfill a contract or for measures preliminary to a contract.
Contact form
Should you send us questions via the contact form, we will collect the data entered on the form, including the contact details you provide, to answer your question and any follow-up questions. We do not share this information without your permission. We will, therefore, process any data you enter onto the contact form only with your consent per Art. 6 (1)(a) DSGVO. You may revoke your consent at any time. An informal email making this request is sufficient. The data processed before we receive your request may still be legally processed. We will retain the data you provide on the contact form until you request its deletion, revoke your consent for its storage, or the purpose for its storage no longer pertains (e.g. after fulfilling your request). Any mandatory statutory provisions, especially those regarding mandatory data retention periods, remain unaffected by this provision.
Registration on this website
You can register on our website in order to access additional functions offered here. The input data will only be used for the purpose of using the respective site or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will reject your registration. To inform you about important changes such as those within the scope of our site or technical changes, we will use the email address specified during registration. We will continue to store the data collected during registration for as long as you remain registered on our website. Statutory retention periods remain unaffected.
Data collection on our applications
Anonymized collection of usage data
Collection of usage data in our applications
Data is collected and stored in our applications using a self-developed component. This is done on the basis of our legitimate interest in the statistical analysis of user behavior to improve our applications in accordance with Art. 6 para. 1 lit. f GDPR. Anonymized clusters can be created and evaluated from this data for the same purpose.
When you use our software, we collect the following data:
- Anonymized, unique identification number
- Product used including edition and version
- Number of licenses within the license key used
- Calendar year of the first purchase of this license
- Assignment of private or business customer
- Assignment of direct customer or customer of a reseller
- Assignment system as part of a corporate network
- Assignment of the system to a Windows server or client
- Assignment of system location and time zone
- Frequency of use of the application in general and individual functions in particular
- Service life of the application in general and individual functions in particular
The data collected (including your anonymized unique identification number) is processed on our own servers in Germany and is never passed on or sold to third parties.
The information we store cannot be used to personally identify you as a customer of JAM Software or user of our software due to anonymization.
We store the information we collect for a maximum of two years so that we can use it for evaluation purposes. At the end of the two years, we automatically remove the collected data from our systems.
Ensuring anonymity in the collection of usage data
In order to ensure maximum anonymity when collecting usage data, the anonymization procedure is implemented as follows:
When using our applications, we check whether the software instance has already been assigned a unique identification number ("Unique ID").
If this is not the case, the application collects the above-mentioned context information with the help of a data comparison in our customer base using the license key and then generates a Unique ID. This data retrieval only takes place once when a new Unique ID is created.
The unique ID is then securely transmitted to our system together with the usage data and a time stamp and processed there.
All data is strictly anonymized in order to protect the privacy of users. This information is used exclusively to analyze and improve the user experience and does not allow any conclusions to be drawn about an individual person, but only about clusters.
Revocation of the collection and storage of usage data
You have the right to object to the storage and analysis of your usage data, even if the data collected cannot be traced back to you as a person due to anonymization.
If you do not agree to the storage and analysis of this data, you can object to its storage and use at any time in the settings of our applications.
Anonymized collection of user feedback
In order to continuously improve our applications, we ask users for feedback via feedback modules within our applications.
After performing certain actions within our applications, pop-ups may appear asking you to rate the application. The answers are recorded and transmitted together with the previously assigned anonymous, unique identification number ("Unique ID").
This procedure ensures that the feedback is processed without personal identification, thus ensuring complete anonymity. Collecting feedback in this way enables us to work specifically on optimizing our applications and services.
Processing and transmission of data
Processing of data (customer and contract data)
We collect, process, and use personal data only insofar as it is necessary to establish, or modify legal relationships with us (master data). This is done based on Art. 6 (1) (b) DSGVO, which allows the processing of data to fulfill a contract or for measures preliminary to a contract. We collect, process and use your personal data when accessing our website (usage data) only to the extent required to enable you to access our service or to bill you for the same. Collected customer data shall be deleted after completion of the order or termination of the business relationship. Legal retention periods remain unaffected.
Data transmitted when entering into a contract with online shops, retailers, and mail order
We transmit personally identifiable data to third parties only to the extent required to fulfill the terms of your contract, for example, to companies entrusted to deliver goods to your location or banks entrusted to process your payments. Your data will not be transmitted for any other purpose unless you have given your express permission to do so. Your data will not be disclosed to third parties for advertising purposes without your express consent. The basis for data processing is Art. 6 (1) (b) DSGVO, which allows the processing of data to fulfill a contract or for measures preliminary to a contract.
Data transferred when signing up for services and digital content
We transmit personally identifiable data to third parties only to the extent required to fulfill the terms of your contract with us, for example, to banks entrusted to process your payments.
Issue-Tracking (Software Support)
If a user of our software products reports an error, problem, request or suggestion for improvement, a ticket may get created for this in our internal issue tracker. The name, e-mail address and customer number of the customer may be stored together with the ticket in order to be able to make queries about the problem later. The customer data will be deleted 3 years after the ticket has been closed in the system.

Data processing through social networks
We maintain publicly available profiles in social networks. The individual social networks we use can be found below.
Social networks such as Facebook, Twitter etc. can generally analyze your user behavior comprehensively if you visit their website or a website with integrated social media content (e.g., like buttons or banner ads). When you visit our social media pages, numerous data protection-relevant processing operations are triggered. In detail:
If you are logged in to your social media account and visit our social media page, the operator of the social media portal can assign this visit to your user account. Under certain circumstances, your personal data may also be recorded if you are not logged in or do not have an account with the respective social media portal. In this case, this data is collected, for example, via cookies stored on your device or by recording your IP
address.
Using the data collected in this way, the operators of the social media portals can create user profiles in which their preferences and interests are stored. This way you can see interest-based advertising inside and outside your social media presence. If you have an account with the social network, interest-based
advertising can be displayed on any device you are logged in to or have logged in to. Please also note that we cannot retrace all processing operations on the social media portals. Depending on the provider, additional processing operations may therefore be carried out by the operators of the social
media portals. Details can be found in the terms of use and privacy policy of the respective social media portals.
Legal basis
Our social media appearances should ensure the widest possible presence on the Internet. This is a legitimate interest within the meaning of Art. 6 (1) lit. f GDPR. The analysis processes initiated by the social networks may be based on divergent legal bases to be specified by the operators of the social networks (e.g., consent within the meaning of Art. 6 (1) (a) GDPR).
Responsibility and assertion of rights
If you visit one of our social media sites (e.g., Facebook), we, together with the operator of the social media platform, are responsible for the data processing operations triggered during this visit.
Please note that despite the shared responsibility with the social media portal operators, we do not have full influence on the data processing operations of the social media portals. Our options are determined by the company policy of the respective provider.
Storage time
Stored cookies remain on your device until you delete them. Mandatory statutory provisions - in particular, retention periods - remain unaffected. We have no control over the storage duration of your data that are stored by the social network operators for their own purposes. For details, please contact the social network operators directly (e.g., in their privacy policy, see below).
Your rights
You have the right to receive information about the origin, recipient and purpose of your stored personal data at any time and free of charge. You also have the right to object, the right to data portability and the right to file a complaint with the responsible regulatory agency. Furthermore, you can request the correction, blocking, deletion and, under certain circumstances, the restriction of the processing of your personal data.
